Please note: By selecting the option “Accept the following policy terms and conditions” serves as a digital e-signing to this document and acknowledging that you, the operator accept the terms and conditions on which you, the operator will use the Malelane Aerodrome and that you, the operator are agreeing that your use of Malelane Aerodrome will be in terms of and limited to, what is explained below.  The effect of this agreement is that you, the operator may not make any claim against Malelane Aerodrome and or Malelane Airport (Pty) Ltd and or their respective directors, officers, employees, partners, contractors and or their respective successors in title and or their underwriters and insurers (herein after referred to collectively as “MALELANE AIRPORT”) expected for those expressly provided for in this agreement.  You acknowledge that should you cause any damage or loss to MALELANE AIRPORT as a result of Malelane Aerodrome, you will be fully liable and responsible to MALELANE AIRPORT for the cost of repairing the damage.  Furthermore, should you, the operator bring any claims against MALELANE AIRPORT connected to our use of Malelane Aerodrome, which claims are ultimately defeated by MALELANE AIRPORT, you, the operator agree to pay (indemnify) MALELANE AIRPORT any cost (legal or otherwise) incurred by MALELANE AIRPORT in respect of such claims.  In addition, you the operator agree to indemnify (pay) MALELANE AIRPORT for any claims brought by any third party against MALELANE AIRPORT connected to your use of Malelane Aerodrome, as well as any costs (legal or otherwise) incurred by MALELANE AIRPORT in respect of such claims.

Please ask for further explanation if there is anything that you do not understand before you sign this document.

1. MALELANE AERODROME

1. 1. Malelane Aerodrome is a licensed Category 2 aerodrome, located at co-ordinates 25 28 24 south / 31 33 56 east.  I acknowledge that I have been referred to AIP (Aeronautical Information Publication) for AIP FAMN (Malelane Aerodrome) for further information prior to my use of Malelane Aerodrome.
      
   2. Malelane Aerodrome is not licensed for night operations.  I acknowledge that I have been referred to AIP FAMN for further information prior to my use of Malelane Aerodrome.
      
   3. Rescue and Fire Fighting Services are not provided at Malelane Aerodrome.  I acknowledge that I have been referred to AIC (Aeronautical Information Circular) 50-4 / 06-09-29 for further information prior to my use of Malelane Aerodrome.
      
   4. I agree and acknowledge that it is my responsibility to ascertain the appropriateness and suitability of Malelane Aerodrome for my aircraft.  I expressly acknowledge that by granting me permission to use Malelane Aerodrome, MALELANE AIRPORT has not guaranteed or warranted its suitability or appropriateness for use by my aircraft in anyway.
      

2. PERMIT GRANTING PERMISSION TO USE MALELANE AERODROME

1. Permission to use Malelane Aerodrome is granted only when a permit has been issued to you by MALELANE AIRPORT.  I acknowledge that I may not use Malelane Aerodrome until a permit has been duly issued to me by MALELANE AIRPORT.
   
2. A permit will be issued on the basis of the information specified in paragraph 3.1.
   
3. A permit will only be issued after I have paid the prescribed, landing- and other fees specified in paragraph 4.1 and proof of payment has been received by MALELANE AIRPORT.
   

A penalty fee of R3 000 will be charged when landing without permission or a permit number.

3. REQUEST TO USE MALELANE AERODROME

3.1 I confirm that the information submitted is accurate and that subject to successful payment of the landing fees and other fees specified cost estimate total, a permit will be issued to me by MALELANE AIRPORT based on this information.

3.2 I will immediately inform MALELANE AIRPORT of any changes to the above conditions and request a new permit that accurately reflects the conditions of use.

3.3 MALELANE AIRPORT charges users for the use of its facilities, in accordance with these regulatory provisions. 

The categories of airport charges are:

• Landing fees
  
• Aircraft parking fees
  
• Passenger service charges
  
• Hanger Parking (available on request)

Landing fees vary according to the aircraft weight.

For aircraft parking fees, Fixed fee.

Passenger Service Charges (PSC) are charged on departures only.

Hanger Parking, Fixed hourly rate.

4. PAYMENT OF PRESCRIBED LANDING- AND OTHER FEES

4.1 Prescribed landing- and other fees consist of the following:

  • Hanger Rental
    

4.2 I acknowledge that an amount is payable by me to MALELANE AIRPORT in respect of my use of Malelane Aerodrome

I acknowledge that permission to use Malelane Aerodrome is subject to successful payment of the full cost estimate total amount specified in digital order placed.

A permit to use Malelane Aerodrome will only be issued once proof of payment has been received.

5. GENERAL CONDITIONS OF THE USE OF THE MALELANE AERODROME

5.1 I agree to comply at all times during my use of Malelane Aerodrome with any laws regulations and directives of whatsoever nature applicable to the maintenance and operation of my aircraft, including but not limited to the following:

5.1.1 Civil Aviation Act, 2009 and the regulations promulgated thereunder and amended from time to time;

5.1.2 The South African Civil Aviation Technical Standards;

5.1.3 Any and all applicable AIP’s, including but not limited to AIP FAMN;

5.1.4 Any and all applicable AIC’s, including but not limited to AIC 50-4 / 06-09-29;

5.1.5 My aircraft manufacturer’s maintenance and operation manuals; and

5.1.6 Any and all airworthiness directives, service bulletins, service information letters or the like issued by the Civil Aviation authority, aircraft manufacturer or other competent authority.

5.2. I acknowledge that Malelane Aerodrome is not licensed for night operations and that I will under no circumstances operate aircraft into or out of Malelane Aerodrome whilst in night operation conditions.

5.3. I acknowledge that am I responsible for and will ensure the safe management and movement of passengers flown or to be flown on my aircraft at all times whilst those passengers are present at the Malelane Aerodrome including during embarkation and disembarkation of the aircraft.

5.4. I will comply with any reasonable and lawful instruction issued by Malelane Aerodrome or MALELANE AIRPORT in relation to the use of Malelane Aerodrome.

5.5. I will not interfere with the operation of any other user of the Malelane Aerodrome.

6. LIABILITY FOR DAMAGE CAUSED WHILST USING MALELANE AERODROME

6.1 I agree to irrevocably and forever release and discharge MALELANE AIRPORT from all liability in respect of all and any claims, losses (including but not limited to consequential losses), causes of action, damages, interest and costs of any nature whatsoever, including but not limited to any and all future and unascertained damages, arising from or following or in any way connected to my use of Malelane Aerodrome, unless directly attributable to the gross negligence of MALELANE AIRPORT.

The effect of this clause is that MALELANE AIRPORT will not be liable for and you will have no claim against MALELANE AIRPORT for any loss, damage or other claim of whatsoever nature arising from or related to your use of Malelane Aerodrome unless directly attributable to the gross negligence of MALELANE AIRPORT.

7. INDEMNIFICATIONS PROVIDED BY YOU TO MALELANE AIRPORT

7.1 I hereby indemnify MALELANE AIRPORT from, for and against any claim, demand, action, joinder, cause of action, loss (including but not limited to any consequential loss) and or expense of whatsoever nature, including but not limited to any and all future and unascertained damages, arising from or following or in any way connected to my use of Malelane Aerodrome unless arising from the gross negligence of MALELANE AIRPORT.

The effect of this clause is that if you cause any damage to Malelane Aerodrome or cause MALELANE AIRPORT any loss of any kind, you will be responsible to indemnify (pay) MALELANE AIRPORT for such loss.

In addition, the effect of this clause is that if any third party (including but not limited to passengers or crew) makes or brings any type of claim against MALELANE AIRPORT arising from or following or in any way connected to your use of Malelane Aerodrome, you will responsible to indemnify (pay) MALELANE AIRPORT to the value of that claim, as settled by MALELANE AIRPORT directly with the third party (claimant) or as ordered to pay by judgement.

7.2 In addition, I hereby indemnify MALELANE AIRPORT from, for and against any legal or other expenses which may incur as a result of and or I consequence of my use of Malelane Aerodrome and or as a result of and or in consequence of any claim, demand, action, joinder, cause of action, loss and or expense of whatsoever nature referred to in clauses 6.1 and 7.1 above.

The effect of this clause is that if you makes or bring any type of claim against MALELANE AIRPORT arising from or in any way connected to your use of Malelane Aerodrome, which claim is successfully defended by MALELANE AIRPORT, you will be responsible to pay to MALELANE AIRPORT the cost of any and all legal or other expenses incurred by MALELANE AIRPORT.  In addition, if any third party (including but not limited to passengers or crew) make or bring any type of claim against MALELANE AIRPORT arising from or in any way connected to your use of Malelane Aerodrome you will be responsible to pay the MALELANE AIRPORT the cost of any legal or other expenses incurred by MALELANE AIRPORT.
